1. Purpose
These general terms and conditions define the rights and obligations of the parties within the framework of the remote booking of services offered by our establishment, whose contact details are specified in this booking confirmation document. They govern all the steps necessary for booking and monitoring the booking between the contracting parties. The client acknowledges having read and accepted these general terms and conditions of sale and the terms and conditions of sale of the reserved rate, accessible on our booking platform. These general terms and conditions of sale apply to all bookings made online, via our booking platform.
2. Booking
The client selects the services presented on our booking platform. The customer acknowledges having reviewed the nature, purpose, and booking procedures for the services available on our booking platform and having requested and obtained all necessary and/or additional information to make an informed booking. The customer is solely responsible for their choice of services and their suitability for their needs; therefore, we cannot be held liable in this regard. The booking is deemed accepted by the customer upon completion of the booking process. 3. Booking Process: Bookings made by the customer are processed via the online booking form accessible on our booking platform. The booking is considered confirmed upon receipt of the booking form. Prior to making any booking, the customer agrees to complete the information requested on the booking form or request. The customer attests to the truthfulness and accuracy of the information provided. After the final selection of services to be booked, the booking process includes, in particular, entering credit card details if a guarantee or prepayment is required, reviewing and accepting the general terms and conditions of sale and the terms and conditions of the selected rate before confirming the booking, and finally, the customer's confirmation of the booking.
4. Booking Confirmation
Our booking platform acknowledges receipt of the customer's booking by sending an email without delay. In the case of online booking, the booking confirmation email summarizes the contract offer, the services booked, the prices, the terms and conditions of sale related to the selected rate and accepted by the customer, the booking date, after-sales service information, and the address of the seller's establishment where the customer can submit complaints.
5. Cancellation or modification by the customer
The customer is reminded, in accordance with Article L. 221-28 12° of the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 121-21 of the French Consumer Code.
Payment for the entire service is due at the time of booking. The terms and conditions of the reserved rate specify the cancellation and/or modification procedures, depending on the cancellation period. For any cancellation less than 7 days in advance, the full payment is retained as a fixed cancellation fee. Between 30 and 8 days, half the price of the stay will be refunded, less the platform's transaction and service fees. Beyond 30 days, the entire stay will be refunded, the amount paid by the Client minus the platform's transaction and service fees. In this case, it is mentioned in the rate's terms and conditions. When the reserved rate's terms and conditions allow, as indicated on our platform, the reservation can be cancelled directly with the establishment, whose telephone number is provided on the booking confirmation sent by email. All reservations are nominative and may not be transferred to a third party under any circumstances, whether free of charge or for payment. In any event, any sums refunded in the event of cancellation due to exceptional circumstances will be refunded after deduction of bank and platform fees. 6. Use of the Service In accordance with French regulations, the client will be asked to complete a police registration form upon arrival. To do so, the client will be asked to present identification to verify whether or not they are required to complete the form. Any behavior contrary to public decency and order will lead the establishment to ask the customer to leave the premises without any compensation or refund, even if payment has already been made. For the peace and quiet of both the customer and the host, the neighborhood, and the principles of community life within the municipality of Serris-Val d'Europe, the customer is asked to respect the Internal Regulations. The customer accepts and agrees to abide by said regulations. In the event of non-compliance by the client with any of the provisions of the House Rules, the establishment will be obliged to ask the client to leave the premises without any compensation or refund, even if payment has already been made. The client is informed that: - The room includes a 160x200 cm bed, a shower room, and storage furniture. A screen is provided, with internet access available. The establishment does not offer a TV package. Wi-Fi access is available. - The establishment is non-smoking and non-vaping. Smoking and/or vaping are strictly prohibited in the room. Pets are not allowed on the premises. Check-in is between 4 PM and 10 PM, and check-out is before 11 AM. Access to the swimming pool is free and unsupervised from 10 AM to 8 PM. Jumping or running around the pool is strictly prohibited. The establishment offers lunch or dinner. In accordance with regulations, breakfast is included in the bed and breakfast accommodation. A set menu dinner may also be offered to guests at lunchtime and in the evening, under the conditions specified by current legislation and the house rules. Reservations, with payment, must be made before 6:00 PM the day before for lunch, and before 12:00 PM on the same day for dinner. The "table d'hôte" (set menu) consists of welcoming guests to the family table. The meal includes an appetizer, main course, dessert, and drinks. Prices are specified in the updated price list of the house rules.
7. Liability
The establishment cannot be held liable for the non-execution or improper execution of the reservation in cases of force majeure, actions of third parties, or actions of the client, including but not limited to internet network unavailability, inability to access the website, external intrusion, computer viruses, or in the event of unauthorized prepayment by the cardholder's bank. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the customer.
8. Complaints
Complaints relating to the non-performance or improper performance of the services booked must, under penalty of forfeiture, be brought to our attention in writing within fourteen days of the departure date from the establishment, and if possible as soon as they are noticed.

9. Prices
The prices relating to the booking of services are indicated before and during the booking process. Prices are confirmed to the customer inclusive of all taxes, in the establishment's local currency, and are valid only for the period indicated on the booking platform. If payment is made to the establishment in a currency other than that confirmed on the booking, the exchange fees are the responsibility of the customer. All bookings, regardless of origin, are payable in the establishment's local currency, unless otherwise specified on-site. Unless otherwise stated on the booking platform, additional services are not included in the price. Any applicable taxes (local taxes, tourist taxes, etc.), listed on the rates page and included in the house rules, must be paid directly to the establishment on-site, before the service is provided. Prices include VAT applicable on the day of the order, and any change in the applicable VAT rate will be automatically reflected in the prices shown on the invoice date. Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the invoice date.
10. Payment
The total payment is debited at the time of booking via the platform. In the event of a no-show (reservation not canceled – customer not present) for a reservation paid by credit card, the establishment will retain, as a fixed compensation, the amount paid by the Customer. The cancellation and refund conditions are specified in Article 5.
The establishment has chosen elloha.com/stripe.com to secure online credit card payments. The validity of the customer's payment card is verified by stripe.com. A payment card may be declined for several reasons: stolen card, blocked card, spending limit reached, incorrect entry, etc. In case of a problem, the customer should contact their bank and the establishment to confirm their reservation and payment method.
11. Privacy Policy
On each personal data collection form, the customer is informed whether responses are mandatory or optional by the presence of an asterisk. The information processed is intended for the establishment, elloha.com, its entities, its partners, and its service providers (including online payment providers). The customer authorizes elloha.com to share their personal data with third parties, provided that such sharing is compatible with the performance of the operations incumbent upon elloha.com under these terms and conditions and in accordance with the Customer Charter for the Protection of Personal Data. In particular, during online payment, the customer's bank details must be transmitted by the payment provider stripe.com to the establishment's bank for the execution of the booking contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection as defined by the French Data Protection Act (Loi Informatique et Libertés). However, the customer consents to this transfer, which is necessary for the execution of their booking. Constellation SAS / Stripe.com, in their capacity as professionals, have committed to the establishment to take all necessary security measures and ensure the confidentiality of data for these data transfers. Personal Data Protection (GDPR)
In the context of managing reservations and welcoming guests, the establishment collects certain personal data (surname, first name, address, telephone number, email address, information relating to the stay and, where applicable, data required by current regulations). This data is processed solely for the purposes of managing reservations, fulfilling the accommodation contract, invoicing, and complying with legal obligations. (Police form) and, with the client's consent when required, for sending commercial information.Personal data is kept for the period necessary to fulfill the purposes for which it was collected and in accordance with applicable legal obligations.
The establishment undertakes to implement appropriate technical and organizational measures to ensure the security and confidentiality of personal data and not to disclose it to unauthorized third parties.
In accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the amended French Data Protection Act, each client has the right to access, rectify, erase, restrict processing, object to processing, and obtain a copy of their personal data. These rights can be exercised by sending a request to: [contact email address].
The customer also has the right to lodge a complaint with the National Commission for Information Technology and Civil Liberties (CNIL) if they believe their rights have not been respected.
Customer personal data is not sold, rented, or transferred directly for commercial purposes by the establishment.
The establishment attaches particular importance to the protection of its customers' privacy and undertakes to process their personal data transparently, confidentially, and in accordance with applicable regulations.
12. Evidence Agreement
Entering the required bank details, as well as accepting these terms and conditions and the booking confirmation or request, constitutes an electronic signature which, between the parties, has the same legal value as a handwritten signature. The computerized records stored in the computer systems of elloha.com will be kept under reasonable security conditions and considered as proof of communications, orders, and payments made between the parties. The customer is informed that their IP address is recorded at the time of booking.
13. Force Majeure
Force majeure is defined as any event beyond the control of the parties that is both unforeseeable and insurmountable, preventing either the customer or the establishment from fulfilling all or part of the obligations stipulated in the contract. Events of force majeure or fortuitous events are those usually recognized by the jurisprudence of French courts and tribunals. Neither party shall be held liable to the other for any failure to perform its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends the performance of the parties' reciprocal obligations and that each party shall bear its own costs arising therefrom. 14. Dispute Resolution
These General Terms and Conditions of Sale are governed by French law without prejudice to any mandatory protective provisions that may apply in the consumer's country of residence.

15. Entire Agreement
These General Terms and Conditions of Sale, the terms and conditions of the rate reserved by the customer, and the booking confirmation or request constitute the entire agreement between the parties. No general or specific terms and conditions communicated by the customer may be incorporated into these general terms and conditions. The documents forming the contractual commitments between the parties are, in descending order of priority, the booking confirmation or request (including the specific terms and conditions of the reserved rate) and these general terms and conditions. In the event of any conflict between the booking confirmation and the general terms and conditions, the provisions contained in the booking confirmation shall be the only ones applicable to the obligation in question. These general terms and conditions of online sale may be modified and/or supplemented by the establishment at any time. In this case, the new version of the general terms and conditions of online sale will be published online by the establishment. Once published online, the new version of the general terms and conditions of online sale will automatically apply to future customers.
